Types of marriages and registration routes in India

India has multiple marriage routes because personal law, civil marriage and state-level registration procedures operate together. A couple may have a religious ceremony and then register the already solemnised marriage. Another couple may marry under the Special Marriage Act route. Some states and union territories run online or district-level services for registration, while the documentary requirements and appointment steps vary by place.

How the registration process usually works

The Government of NCT of Delhi’s Revenue Department describes marriage registration as registration of marriages that have already been solemnised. It lists the office route, documents, affidavits, photographs and special situations such as divorce decree, death certificate of previous spouse, certificate from priest, and embassy certificate for a foreign national. It also describes a Special Marriage Act route where notice, a waiting period and three witnesses become important.

Do not assume the Delhi sequence is identical everywhere in India. The National Government Services Portal lists marriage-registration services across states and union territories. A practical file should therefore be checked against the local registrar or district portal where the application will be made.

When translation, apostille or attestation becomes necessary

Translation usually becomes relevant in three situations. First, one of the supporting documents is in a language not accepted by the registrar or receiving authority. Second, the Indian marriage certificate must be used abroad. Third, a foreign civil-status paper, divorce decree, single-status certificate, birth certificate or embassy document must be read by an Indian authority.

Translation does not automatically replace apostille or attestation. Apostille and attestation are separate document-authentication routes. If a marriage certificate is for a Hague Convention country, apostille may be requested. If it is for a non-Hague route, embassy or consular legalisation may be relevant. The correct order should be checked before translation is finalised because some authorities want the translation attached after the original is authenticated, while others ask for the translation first.
